What Are My Rights If I Am Injured In a Car Accident In Texas?
In Texas, you have the legal right to hold the at-fault driver responsible for the costs of your recovery. Because Texas is an at-fault state, the person who caused the accident is generally liable for your medical expenses, car repairs, and other related losses through their insurance policy. This is why getting legal help after a crash is recommended.
If an insurance company refuses to offer a settlement that covers your actual needs, you have the right to take your case to court. In most situations, you have a two-year window from the date of the accident to file a lawsuit under the Texas statute of limitations.
Furthermore, if the other driver was uninsured or did not have enough coverage, you have the right to use your own Uninsured Motorist (UM) coverage to pay for your losses, provided you did not waive that protection in writing when you bought your policy.
Your rights might go beyond just getting your bills paid; you are also entitled to seek non-economic damages for how the accident has changed your life. This includes compensation for physical pain, emotional distress, and the loss of enjoyment of your daily activities.
Texas law recognizes that a major crash impacts more than just your bank account, and you have the right to be compensated for the physical and mental toll the injury has taken on you.
