Commercial Vehicle Liability and Evidence Preservation in Kaufman County

When a collision involves a commercial vehicle like an 18-wheeler, the legal landscape in Texas extends beyond the individual driver. Under the doctrine of vicarious liability, an employer is generally held responsible for the negligent actions of their driver, provided the crash occurred while the driver was acting within the "scope of employment." This is a critical distinction, as commercial trucking companies typically carry significantly higher insurance limits than individual passenger vehicle owners, ensuring more adequate resources for catastrophic losses.

Furthermore, you may be able to pursue a claim for negligent entrustment if the company knowingly allowed an unfit, unlicensed, or reckless driver to operate their vehicle. In Texas, proving this requires showing that the owner knew (or should have known) of the driver’s incompetence. This is often where corporate records become the "smoking gun" of a case, potentially revealing a history of safety violations or failed drug tests that the company chose to ignore.

Because commercial carriers own the most vital evidence, such as driver logs, maintenance records, and "black box" data, preserving this information immediately is paramount. In Texas, a spoliation letter is a formal legal notice sent to the trucking company demanding that they retain all evidence related to the crash. Without this, companies may legally destroy certain records, like Electronic Logging Device (ELD) data, after just a few months.

Navigating the aftermath of a serious accident is overwhelming, especially when dealing with insurance adjusters, medical bills, and complex state liability laws. A qualified attorney acts as your advocate, handling all communications with insurance companies and ensuring that critical evidence is preserved and analyzed. By building a strong case on your behalf, an attorney helps you pursue the full compensation you deserve for medical expenses, lost wages, and pain and suffering, allowing you to focus entirely on your recovery.
